Terms and Conditions
Archiving
All finished images from a session will be digitally archived. Please note that, due to the nature of digital media, no guarantees can be made.
Copyright
Darren Hobson Photography retains copyright on all images and reserves the right to use these images and/or reproductions for display, publication, marketing or any other purpose. No use of the images will be made by the photographer for other commercial reasons except with the written permission of the client. You may not use these images for profit, commercial endeavours, in competitions, or for professional display without written permission and understand that you may not copy, duplicate, print or scan the photographs.
Creative Licence
The photographer will be granted complete artistic licence in relation to poses photographs and the locations used and his judgement regarding the locations/poses and number of images taken will be final. The photographer reserves the creative right to remove duplicates, blinks etc and to release for viewing and edit only images that fit with in his artistic standards.
Delivery Times
An estimate of the turnaround time for initial viewing of images will be provided at the time of the session and further details will be provided to you once images are available for viewing. A further estimate of delivery time will be provided at the time of ordering for printed products.
Digital Images
If your purchase includes digital files, you may be provided with advice on printing. To ensure the best print quality avoid altering your images before printing. The photographer is not responsible for printing errors or for the quality of prints or products not provided directly to you by the photographer.
Editing
The photographer will provide a pleasing colour balance but cannot guarantee exact colour matching. It is sometimes impossible to record the exact colour as seen by the human eye. All printed product images sizes are nominal.
Expenses
Wherever possible, expenses incurred by the photographer will be included within session pricing. Should additional expenses be incurred by way of your location choices, you may be responsible for covering these additional costs. These costs include, but are not limited to, admission fees and parking fees. Please note that there may be a charge to cover fuel for travelling significant distances where it is deemed necessary.
Gift Vouchers
Purchased gift vouchers are valid until the date quoted on them, are non-refundable and have no cash value. The buyer is responsible for ensuring the suitability of the purchase and the terms and conditions of Darren Hobson Photography. Promotional or charity vouchers may have a shorter validity.
Liability
In the unlikely event that the photographer is unable to photograph your booked session due to illness, fire, accident, strike, or any other cause beyond our control, then your session fee will be returned, but shall have no further liability with respect to the contract. This limitation on liability shall also apply in the event that photographic materials are damaged or lost in processing through camera or media malfunction without fault on my part. In the event that the photographer fails to perform for any other reason, he shall not be liable for any amount in excess of the retail value of your order.
Refunds
Due to the bespoke nature of printed products all sales are final. However, if you find any product to be faulty, please contact me within 7 days of receipt and I will replace any faulty products deemed to be my fault or that of my suppliers.
Rescheduling
If it becomes necessary for you to postpone your booked session, please get in touch as soon as possible to discuss rescheduling. The photographer retains the right to reschedule if deemed necessary due to inclement weather, illness or emergency. In these instances, you will be contacted as the earliest opportunity to reschedule.
Session Balance
At the time of booking, details will be provided regarding when the full balance for your session is due. Bank transfers are accepted and details are available upon request at the time of booking.
Session Deposit
The deposit quoted at the time of booking is a retainer towards the photographer’s time. It is non-refundable but may be applied to a rescheduled session when necessary, within six months. Session deposits are required in order to secure your session date and quoted prices.
Supervision
You agree that any minor(s) will remain under your supervision throughout sessions and you will remain the responsible adult for the minor(s) at all times.
Viewing and Ordering
Depending on your session requirements, your unedited selection of images will be available for you to view through a private password-protected gallery. This link and password will be made available to you once ready. For other sessions, the edited and finished selection of images will be made available for you to view during a private viewing. For such sessions, a private gallery option may be available for an additional cost.
